Dokle je proces donesenog akcionog plana za izvršenje presuda Evropskog suda za ljudska prava?

presuda-sudijski-cekicU septembru ove godine Vijeće ministara Bosne i Hercegovine, na prijedlog Ministarstva pravde BiH, razmotrilo je i usvojilo Akcioni plan za izvršenje presuda Evropskog suda za ljudska prava u predmetu “Zornić protiv Bosne i Hercegovine” i “Sejdić i Finci protiv Bosne i Hercegovine”, uz prihvaćenu sugestiju da će rokove za realizaciju aktivnosti iz akcionog plana utvrditi radna grupa nakon konstituisanja.

Članovi Radne grupe u ime Vijeća ministara BiH su ministar pravde Josip Grubeša, ministrica za ljudska prava i izbjeglice Semiha Borovac i ministar vanjske trgovine i ekonomskih odnosa Mirko Šarović.

Zaduženo je Ministarstvo pravde da pripremi Prijedlog odluke o formiranju Radne grupe za pripremu prijedloga amandmana na Ustav BiH i usklađivanje Izbornog zakona BiH u skladu s dostavljenim podacima i dostavi je predsjedavajućem Vijeća ministara BiH na potpis. Ministarstvo pravde BiH će pružati administrativnu i tehničku pomoć radnoj grupi, te će o svim njenim aktivnostima informirati Ured zastupnika Vijeća ministara BiH pred Evropskim sudom za ljudska prava u Strazburu.

Presudama “Sejdić i Finci protiv BiH” i “Zornić protiv BiH” utvrđeno je da BiH krši Evropsku konvenciju za zaštitu ljudskih prava i osnovnih sloboda, zbog nemogućnosti aplikanata da se kandidiraju na izborima za Dom naroda Parlamentarne skupštine BiH i za Predsjedništvo BiH.

Akcionim planom se definira usvajanje amandmana na Ustav BiH i usklađivanje izbornog zakonodavstva BiH s ciljem ispravljanja kršenja ljudskih prava i osnovnih sloboda ustanovljenih presudama, saopćeno je iz Vijeća ministara BiH.

Po tužbi Derve Sejdića i Jakoba Fincija, protiv Bosne i Hercegovine, a koji su kao pripadnici nacionalnih manjina bili onemogućeni da budu birani u Predsjedništvo BiH i Dom naroda BiH, Evropski sud za ljudska prava je 22. decembra 2009. u Strasbourgu, donio presudu u kojoj su u deset tačaka dosene odluke o ujedinjenju tužbi, definira tužbu kao ispravnu, donosi presudu, te rješava dodjeljivanje tražene naknade tužiteljima.

Evropski sud za ljudska prava (ECHR) u Strazburu presudio je da su prekršena ljudska prava Azre Zornić, koja je tužila državu Bosnu i Hercegovinu za diskriminaciju, jer se, prema Ustavu BiH, nije mogla kandidovati za Dom naroda i Predsjedništvo BiH pošto se ne izjašnjava kao pripadnica ijednog konstitutivnog naroda.

In September this year the Council of Ministers of Bosnia and Herzegovina, at the proposal of the Ministry of Justice, considered and adopted the Action Plan for the execution of verdicts of the European Court of Human Rights in the case “Zornić against Bosnia and Herzegovina” and “Sejdić and Finci against Bosnia and Herzegovina” with the suggestion that the deadline for implementation of the action plan will establish a working group after the consultation.

Members of the Working Group on behalf of the Council of Ministers are the Minister of Justice Josip Grubeša, Minister for Human Rights and Refugees Semiha Borovac and Minister of Foreign Trade and Economic Relations Mirko Šarović.

Is the Ministry of Justice is in charge to prepare a Draft Decision on the establishment of the Working Group for the preparation of proposals for constitutional reforms and harmonization of the BiH Election Law in accordance with the submitted data and submit it to the Chairman of the Council of Ministers for signature. The Ministry of Justice will provide administrative and technical assistance to the working group and will on all its activities inform the Representative of the Council of Ministers at the European Court of Human Rights in Strasbourg.

Verdicts “Sejdić-Finci against BiH” and “Zornić against BiH” has been shown that BiH violated the European Convention for the Protection of Human Rights and Fundamental Freedoms, because the applicants  are not allowed to stand for election to the House of Peoples and the Presidency of Bosnia and Herzegovina.

The Action Plan defines the adoption of amendments to the Constitution and the harmonization of the electoral legislation of Bosnia and Herzegovina in order to revise the violations of human rights and fundamental freedoms defined in the verdicts, it was announced from the Council of Ministers.

According to the lawsuit Dervo Sejdić and Jakob Finci against Bosnia and Herzegovina, which, as members of ethnic minorities were ineligible for election to the Presidency and House of Peoples of Bosnia and Herzegovina, the European Court of Human Rights on 22 December 2009 in Strasbourg ruled in where in ten point were made decisions to merge complaints, defines a complaint as valid, delivers a verdict, and solves allocation of required compensation to claimants.

The European Court of Human Rights (ECHR) in Strasbourg ruled that they violated human rights of Azra Zornić, who sued the state of Bosnia and Herzegovina for discrimination, because, under the Constitution of Bosnia and Herzegovina, she could not run for the House of Peoples and the Presidency of Bosnia and Herzegovina as she does not clarify herself as member of a single constituent people.
